1. About these terms
These terms apply to businesses that use GatherRatings and to anyone who uses gatherratings.com. GatherRatings is run by SetupMyBusiness (“we”, “us”).
By ordering from us, signing in to the dashboard or using the service, you agree to these terms. If you're agreeing for a business, you confirm you're allowed to do so on its behalf. Customers who only leave a rating on a review page just need to read If you're leaving a rating.
Our Privacy Policy explains how we handle personal information.
2. The service
GatherRatings gives each business location a branded review page, QR codes, a dashboard with ratings and private feedback, and optional email updates. We also sell NFC review cards and one-time Google Business Profile services. We set up your review page as part of your plan.
We improve GatherRatings over time and may change how features work. If a change significantly reduces what your plan includes, we'll tell you before it happens.
3. Accounts and access
- We create dashboard accounts for the people you name. Each person needs their own account.
- Keep passwords and two-factor codes private. You're responsible for what happens under your accounts.
- Tell us straight away if you think someone has got into an account without permission.
- We may require two-factor sign-in and may lock an account to protect it.
4. Plans, prices and payment
- Our current prices are on our pricing section, in US dollars, or Pakistani rupees for customers in Pakistan. The price on your order or invoice is the one that applies to you.
- Plans are billed monthly or yearly. Locations beyond what your plan includes are billed per location.
- Payment is due as stated on your invoice. Any taxes that apply are shown on the invoice.
- We'll give you at least 30 days' notice before a price change applies to your plan.
If a payment is overdue, we'll contact you first. If it stays unpaid, we may pause your review pages until it's paid.
5. Cancellation and refunds
- Monthly plans: cancel at any time. Your plan stays active until the end of the month you've paid for and then stops. We don't refund part-months.
- Yearly plans: if you cancel within 14 days of paying, we refund the full yearly payment. After 14 days, your plan stays active until the end of the paid year, and we don't refund the rest of the year.
- NFC cards and custom cards: not refundable once they've been made or programmed, because they're produced for your business. Faulty cards are reprogrammed or replaced, as described in NFC cards and printed codes.
- Google Business Profile setup and optimization: not refundable once the work has been delivered.
To cancel, use the contact form on our home page from the email address we have for your business. Nothing here affects rights you have under consumer law where you live.
6. NFC cards and printed codes
- NFC cards open your GatherRatings review page, so they're used with an active GatherRatings plan.
- Cards are programmed with your review page link and tested before they're sent. Where the chip supports it, we lock them so they can't be rewritten.
- Custom branded cards are made with the logo and design you provide or approve. Delivery time and shipping cost are confirmed when you order.
- Tapping works on phones with NFC switched on. Phones without NFC can scan the QR code instead.
- If a card doesn't work when it arrives, tell us and we'll check it and reprogram or replace it if it's faulty.
- Cards and QR codes point to your GatherRatings review page. If your plan ends or your page is paused, they no longer lead to your review page.
7. Following Google's review rules
Reviews on Google are covered by Google's policies. By default, every customer is offered the Google review link, whatever rating they give, and we never write, post or buy reviews. A business can turn on an option that shows customers who give 1 to 3 stars a private feedback form instead of the Google link. Google's policies don't allow this, and a business that turns it on does so at its own risk. When you use GatherRatings, you agree not to:
- offer discounts, gifts, prizes or anything else in return for reviews;
- ask only happy customers for reviews, or discourage anyone from leaving a negative one;
- review your own business, or ask staff, family or anyone paid by you to do so;
- post, buy or arrange fake reviews;
- set staff targets or rewards based on the number or rating of reviews;
- ask us to change your page so only some customers see the Google review link.
Google decides which reviews appear and can take action against business profiles that break its rules. We don't control that, and we can't restore reviews or profiles that Google removes.
8. Your customers' information
You decide what your review page asks customers for and what you do with their feedback. You're responsible for using it lawfully. In particular, only send marketing to customers who agreed to it, and stop when they ask.
We store and process your customers' information for you, only to run the service, as described in our Privacy Policy. We don't sell it or use it to market to them.
9. Your content
You keep ownership of your logo, brand and anything else you give us. You allow us to use it to provide the service, for example on your review page, cards, QR codes and emails. You confirm you have the right to let us use it. We won't use your business name or logo in our own marketing without your permission.
10. Acceptable use
You agree not to:
- use GatherRatings for anything unlawful, misleading or harmful;
- pretend to be another business or person;
- try to get around security, access other businesses' data, or overload the service;
- copy, resell or reverse engineer the service, or upload malicious code.
11. Our property
The GatherRatings software, design and name belong to us. While your plan is active, you may use the service for your own business locations. These terms don't give you any other rights to it.
12. No guaranteed results
We can't promise how many reviews you'll get, what customers will say, or how your business will rank on Google. A tap on the Google review button is counted as a click, not a published review. Google controls its own products and can change them at any time.
13. Availability
We work to keep GatherRatings running reliably, but we can't guarantee it will always be available or free of errors. It may be briefly unavailable for maintenance or because of problems with our providers or the internet.
14. Pausing and ending the service
You can stop using GatherRatings at any time by telling us (see Cancellation and refunds). We may pause or end your service if you seriously or repeatedly break these terms, especially Google's review rules, or don't pay. Where it's reasonable, we'll tell you first and give you a chance to fix the problem.
When the service ends, your review pages go offline. Before then, you can export your feedback from the dashboard as a CSV file. You can also ask us to delete your business's data.
15. Liability
As far as the law allows, the service is provided “as is”, and we aren't liable for indirect or consequential losses, such as lost profits, lost reviews, or action Google takes against your profile.
As far as the law allows, our total liability to you for any claim is limited to the amount you paid us in the 12 months before the claim. Nothing in these terms limits liability that can't legally be limited.
You're responsible for claims made against us because you broke these terms, Google's rules or the law when using GatherRatings, including how you use your customers' information.
16. If you're leaving a rating
Review pages are free for customers. Please be honest and don't send abusive, unlawful or spam content. The business sees what you send. If you go on to write a Google review, Google's own terms apply to it.
17. Changes to these terms
We may update these terms. We'll change the date at the top of this page and, for significant changes, email the businesses we work with before the changes take effect. If you keep using GatherRatings after that, the new terms apply.
18. Governing law
These terms are governed by the laws of the State of New York, USA. If you're a consumer, you also keep any protections the law where you live gives you.
